OxGuide Terms of Service

1. Agreement to Terms

By downloading, installing, or using the OxGuide mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and OxGuide (“we,” “us,” or “our”).

2. Description of Service

OxGuide is a mobile application that provides:

AI-powered tour guide for Oxford landmarks and attractions
Turn-by-turn navigation to points of interest
Landmark detection using your device’s camera
Curated tours and itineraries for exploring Oxford
In-app purchases for premium features and day passes

The App is designed to enhance your experience exploring Oxford, United Kingdom.

3. Eligibility

To use the App, you must:

Be at least 13 years of age (or 16 in certain jurisdictions)
Have the legal capacity to enter into a binding agreement
Not be prohibited from using the App under applicable laws

If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account using:

Email and password, or
Google Sign-In

You agree to provide accurate, current, and complete information during registration.

4.2 Account Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

We are not liable for any loss arising from unauthorized use of your account.

4.3 Account Deletion

You may delete your account at any time by:

Using the in-app account deletion feature (Profile > Help & About > Delete Account), or
Contacting us at hello@oxguide.com

Upon deletion, all your personal data — including your profile, saved lists, chat history, and purchase records — will be permanently removed from our systems. This action cannot be undone.

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscriptions and Purchases

5.1 Premium Features

The App offers premium features through in-app purchases:

Day Passes: 1-day, 2-day, 3-day, and 7-day access options
Premium features include unlimited landmark access and extended AI Guide usage

5.2 Payment

All purchases are processed through Apple App Store or Google Play Store
Prices are displayed in your local currency and include applicable taxes
Payment is charged to your App Store or Play Store account upon confirmation

5.3 Activation

Purchased day passes must be activated before use
Once activated, the pass duration begins immediately
Passes cannot be paused, extended, or transferred

5.4 Refunds

Refund requests must be made through Apple App Store or Google Play Store
We do not process refunds directly
Refund eligibility is subject to the respective store’s policies

5.5 Price Changes

We reserve the right to modify pricing at any time. Price changes will not affect already-purchased passes.

6. Free Trial

6.1 Trial Terms

New users may be eligible for a free trial that includes:

Limited access to landmarks (up to 3)
Limited AI Guide questions (up to 10)
24-hour trial period

6.2 Trial Limitations

One trial per user/device
Trial benefits cannot be combined with paid passes
We reserve the right to modify or discontinue trials

7. Acceptable Use

7.1 You Agree To:

Use the App only for lawful purposes
Follow all applicable local, national, and international laws
Respect the rights and safety of other users

7.2 You Agree NOT To:

Use the App while operating a vehicle or in unsafe situations
Attempt to reverse-engineer, decompile, or hack the App
Circumvent security features or access restrictions
Use the App to harass, abuse, or harm others
Submit false, misleading, or fraudulent information
Use automated systems or bots to access the App
Infringe upon intellectual property rights
Resell or commercially exploit the App without permission
Use the AI Guide for illegal, harmful, or abusive purposes

7.3 AI Guide Usage

When using the AI Guide feature:

Keep questions relevant to landmarks, Oxford, and tourism
Do not attempt to manipulate the AI for harmful content
Understand that AI responses are informational and may contain errors
Do not rely on AI responses for safety-critical decisions

8. Safety Disclaimer

Always be aware of your surroundings when using navigation features
Do not use the App while driving, cycling, or in situations requiring full attention
Follow all traffic laws and pedestrian guidelines
The App is not a substitute for proper situational awareness

8.2 Physical Safety

Some landmarks may have restricted access, opening hours, or entry fees
Verify accessibility and safety conditions before visiting locations
We are not responsible for injuries or incidents during tours

8.3 Accuracy Disclaimer

Navigation routes are provided for guidance only
Landmark information may be outdated or inaccurate
AI Guide responses are generated and may contain errors
Always verify critical information from official sources

9. Intellectual Property

9.1 Our Intellectual Property

The App and its contents are protected by intellectual property laws:

App design, code, and functionality
OxGuide name, logo, and branding
AI Guide content and responses
Curated tour routes and descriptions

9.2 Your Content

By submitting content (e.g., feedback), you grant us a non-exclusive, royalty-free license to use, modify, and display such content for improving the App.

9.3 Third-Party Content

Map data is provided by Mapbox and subject to their terms
Place information is sourced from Google Places API
Landmark images may be subject to third-party copyrights

10. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

11. Disclaimers

11.1 “As Is” Provision

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of content

11.2 Service Availability

We do not guarantee:

Uninterrupted or error-free operation
Compatibility with all devices
Availability in all locations
Accuracy of AI-generated content

11.3 Third-Party Services

We are not responsible for third-party services, including:

Map and navigation data accuracy
Place information correctness
Payment processing issues handled by app stores

11.4 Independence

OxGuide is an independent app and is not affiliated with, endorsed by, or sponsored by the University of Oxford or any of its colleges. All university and college names, logos, and trademarks are the property of their respective owners and are used for identification purposes only.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim
We are not liable for damages arising from:
- Your use or inability to use the App
- Unauthorized access to your account
- Errors, omissions, or inaccuracies in content
- Personal injury or property damage related to App use
- Third-party conduct or content

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless OxGuide and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Your content or submissions

14. Termination

14.1 By You

You may stop using the App and delete your account at any time through the in-app deletion feature (Profile > Help & About > Delete Account) or by contacting hello@oxguide.com.

14.2 By Us

We may suspend or terminate your access if you:

Violate these Terms
Engage in fraudulent or illegal activity
Pose a security risk to the App or other users

14.3 Effect of Termination

Upon termination:

Your license to use the App is revoked
Unused portions of purchased passes are forfeited
Provisions that should survive (liability, indemnification) remain in effect

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

Posting updated Terms in the App
Updating the “Last Updated” date
Sending an email for significant changes

Your continued use after changes constitutes acceptance. If you disagree with changes, stop using the App.

16. Governing Law and Disputes

16.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

16.2 Dispute Resolution

Before filing a legal claim, you agree to attempt to resolve disputes informally by contacting us at hello@oxguide.com.

16.3 Jurisdiction

For disputes that cannot be resolved informally, you agree to submit to the exclusive jurisdiction of the courts located in England and Wales.

16.4 Class Action Waiver

To the extent permitted by law, you waive the right to participate in class actions or class arbitrations.

17. General Provisions

17.1 Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and OxGuide regarding the App.

17.2 Severability

If any provision is found unenforceable, the remaining provisions remain in full effect.

17.3 Waiver

Our failure to enforce any right does not constitute a waiver of that right.

17.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

17.5 Force Majeure

We are not liable for failures caused by circumstances beyond our reasonable control (natural disasters, war, pandemics, etc.).
